Registration runs five years from the date of filing (RSA 349:6) and reregistration is required at expiry (RSA 349:8). The Secretary of State forwards a renewal notice and form at least six months before expiry and mails a second notice at least 30 days before. Unless the registration is renewed within 30 days after expiration it is discontinued and the name is abandoned and free, and the Secretary of State cancels from the register every registration more than five years old and not renewed.

RSA 349:10 gives a person, proprietorship, partnership or association that has adopted and registered a trade name an express statutory remedy: it may sue to enjoin any other party's use or display of the name, the court may order the defendant to pay over all profits derived from the use, and it may order counterfeits and imitations destroyed. Fraudulent registration is separately actionable in damages and is a misdemeanor for a natural person, a felony for any other. The register is also screened in both directions: RSA 349:1, IV(a) tests a proposed trade name against entity and reserved names, and RSA 304-C:32, III(a) puts RSA 349 trade names into the LLC name screen, so an active trade name blocks a later entity name that is not distinguishable from it. Two limits: RSA 349:11 preserves common-law rights acquired in good faith, and RSA 304-C:32, VIII lets the owner of a registered trade name form an LLC under that same name.
