How long it lasts

The registration period is five years, and the registration expires on December 31 of the year in which its fifth anniversary falls rather than on the anniversary itself. A renewal may be filed at any time between January 1 and December 31 of that expiration year, and a timely renewal continues the registration for a further five years. If it is not renewed by December 31 of the expiration year the registration expires, and the Secretary of State removes and may purge it. Miss. Code § 75-93-11.

Miss. Code § 75-93-13 is explicit: registration is for public notice only, gives rise to no presumption of an exclusive right to own or use the name, does not affect trademark, service mark, trade name or other name rights previously acquired by others in the same or a similar name, and does not preserve the name against future use or registration by anyone else. The application itself must carry the filer's acknowledgment of that (§ 75-93-7(1)(f)), and § 75-93-7(4) bars the Secretary of State from refusing a registration on the ground that the name is indistinguishable from an existing fictitious business name, registered trademark or entity name.
