A trade name registration is effective for ten years from registration or renewal. The renewal window opens only within the six months before expiration (§ 40-2-105(a)); a $50 renewal application with a statement that the name is still in use in Wyoming keeps it in force for another ten years. The Secretary of State mails notice of the coming expiration in the year before it. A registration not renewed is cancelled from the registration record (§ 40-2-107(a)(ii)).

Wyoming trade name registration is a public claim to the name, not a trademark, and confers no general exclusive market right; § 40-2-109 expressly preserves common-law trade name rights. It does screen: § 40-2-102(a) refuses a trade name that is the same as or deceptively similar to a trademark or service mark registered in Wyoming, or not distinguishable from other business entity names under W.S. 17-16-401. A registration procured by fraud makes the registrant liable for all damages plus costs and attorney fees (§ 40-2-108), and a court or the Secretary of State can cancel a registration that was abandoned, not owned, improperly granted or obtained fraudulently (§ 40-2-107).
